Terms and Conditions - Giveaway

  1. Eligibility:

    • This giveaway ("Giveaway") is open to legal residents of the United States of America who are 18 years of age or older at the time of entry.
    • Employees, representatives, and immediate family members of Platinum Pickleball or Golden Capital LLC and its affiliated partners are not eligible to participate in the Giveaway.

  2. Giveaway Period:

    • The Giveaway begins on May 1st and ends on May 31st, at midnight (EST) ("Giveaway Period"). Platinum Pickleball's ("Sponsor") computer is the official time-keeping device for the Giveaway.

  3. Two Ways to Enter:

    • 1) Via a purchase on the Platinum Pickleball website (www.PlatinumPickleball.com) by the end of the Giveaway Period. Your purchase transaction must be received by 11:59:59 PM EST on the last day of the giveaway period to be eligible to enter the giveaway.
    • Participants will be automatically entered into the giveaway if they shop with us between the start date and the end date.
    • If a participant wishes not to be entered upon their purchase, they must notify us in writing via email after their purchase is made.
    • 2) Alternate entry. See section 8.

  4. Random Winner Selection and Notification:

    • Recipient(s) will be randomly selected from all eligible entries received during the Giveaway Period. The winner is selected via random selection from an internal program that selects at random from the list of entrants' names entered.
    • The recipient will be notified via email, direct message, video or phone call within five (5) days after the Giveaway end date.
    • The recipient must respond within two (2) days of notification to claim their gift.
    • If the recipient does not respond within the specified timeframe, an alternate recipient may be selected.
    • The recipient may be required to complete and return any of the following: Affidavit of Eligibility, Release of Liability, Prize Acceptance Form, and where lawful, a Publicity Release along with a copy of his or hers valid driver's license. A W-9 Tax form may also be needed.
    • All documents, if requested, must be completed and returned within 3 days (including Saturdays, Sundays, and Holidays) of attempted delivery of same. Failure to respond or return requested documents within the time specified or return any prize/prize notification as undelivered or undeliverable will result in disqualification without further notice and an alternate winner will be selected. 
    • In the event a potential winner is deemed ineligible, fails to comply with Official Rules, or is unable to claim the prize as specified, the potential winner will be disqualified and an alternate winner will be selected. The prize award is contingent on eligibility verification and the potential winner completing and returning all required documents. Only three (3) random drawings to select an alternate winner (if necessary) will be conducted, after which the applicable prize will remain un-awarded. 

  5. Prize(s) and Approximate Retail Value (ARV) All prize values are stated in USD:

    • The recipient will receive one (1) PROLITE pickleball paddles of their choice from our site
    • The prizes are non-transferable and cannot be redeemed for cash or any other alternative.
    • The ARV is between $50 and $200 USD.

  6. Release:

    • By participating in the Giveaway, the winner grants Platinum Pickleball and Golden Capital LLC the right to use their name, likeness, and photograph for promotional purposes without further compensation or permission.
    • Entrants/winner(s) agree to release, discharge, and hold harmless Released Parties and their respective successors and assigns from and against any claim or cause of action or liability (including but not limited to, personal injury, death, or damage to or loss of property) arising out of participation in the Giveaway or acceptance of prize, misuse of the prize, or the use of any photo/video/entry, and agree to be bound by the Official Rules and the decisions of the Sponsor and/or Sponsor's representatives, which are final.
    • Acceptance of a prize or prizes constitutes permission for the Sponsor and its agencies to use the winner's name and/or likeness for purposes of advertising and trade without further compensation, including a winners list, unless prohibited by law. In the event there is a discrepancy or inconsistency, between disclosures or other statements contained in any promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control. Sponsor is not responsible for any typographical or other error in the printing or advertising of the offer, administration of the Giveaway, or in the announcement of the prize.

  7. General Conditions:

    • Platinum Pickleball reserves the right to modify, suspend, or terminate the Giveaway at any time without prior notice.
    • Platinum Pickleball reserves the right to disqualify any participant found to violate these Terms and Conditions.
    • By entering the Giveaway, participants agree to release and hold harmless Platinum Pickleball, its affiliates, partners, and Facebook from any liability arising from or related to the Giveaway.
    • This Giveaway is subject to all applicable federal, state, and local laws and regulations. Any disputes arising out of or in connection with this Giveaway shall be governed by the laws of the state of Connecticut.
  8. Alternate Entry 
    • To enter the giveaway without making a purchase, send an email to info@platinumpickleball.com OR fill out our contact form with: your full legal name, email, phone number, age, residential or business shipping address, and reasons why you like (or don't like) our store. If and when we receive this info, we will create an alternate entry for you in our system. This will also add you to our customer list. We do not accept PO Boxes.
    • Emailed entries received without a verifiable or legible address will be deemed incomplete and invalid. Limit to one entry per participant, per Giveaway. Bulk entries will not be accepted. Mail-in entries are not accepted. No mechanically or technologically reproduced entries are permitted.
    • Email entries that are not in the format specified above, that are illegible, inaccurate, incomplete, or reproduced, will be considered null and void.  Proof of submission does NOT constitute receipt. We are not responsible for late, lost, illegible, or misdirected entries that are not received by the deadline. All materials and emails submitted become the property of the Sponsor and will not be returned.
    • No correspondence will be acknowledged or entered into; requests for confirmation of receipt of email entries will not be acknowledged. 
    • The Sponsor must create the alternate entry once it receives the needed info- you can not "checkout" with an alternate entry yourself. 
    • Inaccurate, incorrect, or entries that are missing information will be discarded without notification. It is not our responsibility to approve or request additional information needed to create your entry.

By participating in the Giveaway, participants agree to these Terms and Conditions.
